Lemon Law

Did I Buy A Lemon? That is the first question frustrated consumers ask when seeking the advice of a California Lemon Law attorney.

Under the Song-Beverly Consumer Warranty Act, also known as the Lemon Law you may be entitled to a full refund or a replacement vehicle if:

  • You bought or leased a new or used car, boat, RV, motorcycle, or other consumer good;
  • You were provided a warranty or purchased a service contract at the time of purchase;
  • You have a problem with the vehicle that hasn’t been repaired;
  • You provided the manufacturer or warranty provider with a “reasonable number” of attempts to repair the vehicle, usually more than one or two;
  • The problem substantially impairs the use, value or safety of the product.

Many consumers are confused by the meaning of “reasonable number” of repair attempts. That number depends on your individual circumstances. The law does NOT require a specific number of repair attempts or require you to make the attempts within the first 18 months or 18,000 miles and it does NOT have to be out of service for 30 days before a claim can be brought.

The California Lemon Law applies to both new and used vehicles, and use of a vehicle for work does not necessarily disqualify you from the protections of the law.
